1. Agreement

By accessing or using MOTOWAYPOINT (“Service”), you agree to these Terms and Conditions. If you do not agree, do not use the Service.

2. Eligibility

You must follow applicable laws and be able to form legally binding contracts. You are responsible for your account credentials.

3. User content

You are responsible for the content you create (including meet details and uploaded images). You represent that you have the rights to share that content and that it does not violate applicable laws or third-party rights.

4. Payments and boost credits

Boost credits purchased via Stripe may be used to increase visibility of a meet listing for a limited time. Availability of promotional features may change at our discretion.

5. Acceptable use

• No harassment, hate speech, or illegal activity.
• Do not post personal data of others without permission.
• Do not attempt to interfere with the Service, scrape aggressively, or bypass security.

6. Termination

We may suspend or terminate access to the Service at any time, including if we believe you have violated these Terms, or for legal/compliance reasons.

7. SLA (Service Level Agreement)

We target a web uptime of 99.5% on a monthly basis, excluding:

• Scheduled maintenance and outages announced where reasonably possible.
• Force majeure events.
• Third-party outages (for example, hosting providers).
• Issues caused by your devices, networks, or browsers.

Support response targets: we aim to respond within 48 hours for non-emergency requests. This SLA is a target only and does not create a guaranteed service level or refund entitlement.

8. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, MOTOWAYPOINT and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for claims related to the Service will be limited to the amount you paid for the Service (if any) in the 3 months before the event giving rise to the claim, to the extent permitted by applicable law.

10. Indemnity

You agree to indemnify and hold harmless MOTOWAYPOINT from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your user content, or your violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Australia, and where applicable, the State of Western Australia, without regard to conflict of law principles.
